We are R1 Brushless Motor Lab, LLC., doing business as R1 Wurks ("Company," "we," "us," "our"), a company registered in California, United States at PO BOX 7593, LAGUNA NIGUEL, CA 92607.
We operate the website https://r1wurks.com (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and R1 Brushless Motor Lab, LLC., concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
We recommend that you print a copy of these Legal Terms for your records.

R1wurks 90 Days Limited Warranty
IMPORTANT: BY USING YOUR R1WURKS, MOTOR, BATTERY, ESC, FAN,ACCESSORIES AND TOOL PRODUCT YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE R1WURKS 90 DAYS LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW.

DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY. IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN PERIOD STATED IN R1WURKS RETURN POLICY (FOUND AT ) TO THE R1WURKS.COM STORE OR THE AUTHORIZED DISTRIBUTOR WHERE YOU PURCHASED IT FOR A REFUND.

HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND OTHER RIGHTS YOU MAY HAVE THAT VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). R1WURKS DOES NOT EXCLUDE, LIMIT, OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE ARISING FROM THE NONCONFORMITY OF A SALES CONTRACT. CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE, OR STATE FOR A FULL UNDERSTANDING OF YOUR RIGHTS.

WARRANTY LIMITATIONS SUBJECT TO CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE SET FORTH REMEDIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS, OR IMPLIED. R1WURKS DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, R1WURKS LIMITS THE REMEDIES AND DURATION OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT R1WURKS OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHAT IS COVERED BY THIS WARRANTY?

R1 Brushless Motor Lab,LLC. of Laguna Niguel, California, U.S.A. 92677 (“R1WURKS”) warrants the R1WURKS- Motor, ESC, Battery, Fans, Tools and the R1WURKS-branded accessories contained in the original packaging (“R1WURKS Product”) against defects in materials and workmanship when used normally in accordance with R1WURKS's published guidelines for a period of 90 DAYS from the date of original retail purchase by the end-user purchaser ("Warranty Period"). R1WURKS’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications.

This Warranty does not apply: (a) to consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (c) to damage caused by use with a third party component or product that does not meet the R1WURKS Product’s specifications (R1WURKS Product specifications are available at www.R1WURKS.com under the technical specifications for each product ; (d) to damage caused by accident, abuse, misuse, fire, liquid contact, earthquake or other external cause; (e) to damage caused by operating the R1WURKS Product outside R1WURKS’s published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of R1WURKS ; (g) to an R1WURKS Product that has been modified to alter functionality or capability without the written permission of R1WURKS; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the R1WURKS Product; (i) if any serial number has been removed or defaced from the R1WURKS Product; or (j) if R1WURKS receives information from relevant public authorities that the product has been stolen or if you are unable to deactivate passcode-enabled or other security measures designed to prevent unauthorized access to the R1WURKS Product, and you cannot prove in any way that you are the authorized user of the product (eg. by presenting proof of purchase).

Important: Do not open the R1WURKS Product. Opening the R1WURKS Product may cause damage that is not covered by this Warranty. Only R1WURKS should perform service on this R1WURKS Product.

WHAT WILL R1WURKS DO IN THE EVENT THE WARRANTY IS BREACHED?

If during the Warranty Period you submit a claim to R1WURKS or an R1WURKS distributor in accordance with this warranty, R1WURKS will, at its option:

(i) repair the R1WURKS Product using new or previously used parts that are equivalent to new in performance and reliability,

(ii) replace the R1WURKS Product with the same model (or with your consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability, or

(iii) exchange the R1WURKS Product for a refund of your purchase price.

R1WURKS may request that you replace certain user-installable parts or R1WURKS Products. A replacement part or R1WURKS Product, including a user-installable part that has been installed in accordance with instructions provided by R1WURKS, assumes the remaining term of the Limited Warranty. When an R1WURKS Product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes R1WURKS's property.

HOW TO OBTAIN WARRANTY SERVICE?

Please access and review the online help resources described below before seeking warranty service. If the R1WURKS Product is still not functioning properly after making use of these resources, please contact an R1WURKS representative or, if applicable, an R1WURKS owned retail store ("R1WURKS Retail") or distributor, using the information provided below. An R1WURKS representative or distributor will help determine whether your R1WURKS Product requires service and, if it does, will inform you how R1WURKS will provide it. When contacting R1WURKS via telephone, other charges may apply depending on your location.

Online information with details on obtaining warranty service is provided below.

WARRANTY SERVICE OPTIONS

R1WURKS will provide warranty service through one or more of the following options:

(i) Mail-in service. If R1WURKS determines that your R1WURKS Product is eligible for mail-in service, properly pack and address your R1WURKS product, so that you may ship your R1WURKS Product to R1wurks PO BOX location. Instructions may be sent to you via email or in hard copy with the packaging material. Once service is complete, R1wurks or distributor location will return the R1WURKS Product to you. R1WURKS will pay for shipping to your location if all instructions regarding the method of packaging and shipping the R1WURKS Product are followed.

(ii) Do-it-yourself (DIY) parts service. DIY parts service allows you to service your own R1WURKS Product. If DIY parts service is available in the circumstances, the following process will apply.

(a) Service where R1WURKS requires return of the replaced R1WURKS Product or part. R1WURKS may require a credit card authorization as security for the retail price of the replacement R1WURKS Product or part and applicable shipping costs. If you are unable to provide credit card authorization, DIY parts service may not be available to you and R1WURKS will offer alternative arrangements for service. R1WURKS will ship a replacement R1WURKS Product or part to you with installation instructions, if applicable, and any requirements for the return of the replaced R1WURKS Product or part. If you follow the instructions, R1WURKS will cancel the credit card authorization, so you will not be charged for the R1WURKS Product or part and shipping to and from your location. If you fail to return the replaced R1WURKS Product or part as instructed or return a replaced R1WURKS Product or part that is ineligible for service, R1WURKS will charge your credit card for the authorized amount.

(b) Service where R1WURKS does not require return of the replaced R1WURKS Product or part. R1WURKS will ship you free of charge a replacement R1WURKS Product or part accompanied by instructions on installation, if applicable, and any requirements for the disposal of the replaced R1WURKS Product or part.

(c) R1WURKS is not responsible for any labor costs you incur relating to DIY parts service. Should you require further assistance, contact R1WURKS at the telephone number listed below.

R1WURKS reserves the right to change the method by which R1WURKS may provide warranty service to you, and your R1WURKS Product’s eligibility to receive a particular method of service. Service will be limited to the options available in the country where service is requested. Service options, parts availability and response times may vary according to country. You may be responsible for shipping and handling charges if the R1WURKS Product cannot be serviced in the country it is in. If you seek service in a country that is not the original country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges. Where international service is available, R1WURKS may repair or replace R1WURKS Products and parts with comparable R1WURKS Product and parts that comply with local standards.

LIMITATION OF LIABILITY

EXCEPT AS SPECIFICALLY STATED IN THIS WARRANTY AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, R1WURKS SHALL NOT BE HELD LIABLE FOR INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR DIRECT DAMAGES ARISING FROM ANY WARRANTY OR CONDITION BREACH, OR BASED ON ANY OTHER LEGAL THEORY. THIS INCLUDES BUT IS NOT LIMITED TO DAMAGES SUCH AS LOSS OF USE, LOSS OF REVENUE, LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF CONTRACT PROFITS), LOSS OF MONEY USAGE, LOSS OF ANTICIPATED SAVINGS, BUSINESS LOSS, OPPORTUNITY LOSS, GOODWILL LOSS, REPUTATION LOSS, COMPROMISE, DAMAGE, OR CORRUPTION OF DATA, AND INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE RESULTING FROM VARIOUS CAUSES, INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, RECOVERY, PROGRAMMING, OR DATA REPRODUCTION COSTS LINKED TO THE R1WURKS PRODUCT, OR FAILURE TO MAINTAIN THE PRIVACY OF STORED INFORMATION ON THE R1WURKS PRODUCT.

THIS LIMITATION SHALL NOT BE APPLICABLE TO CLAIMS OF DEATH OR PERSONAL INJURY, OR TO LEGAL LIABILITY UNDER STATUTE FOR INTENTIONAL AND GROSSLY NEGLIGENT ACTS AND/OR OMISSIONS. R1WURKS DOES NOT WARRANT THAT IT WILL SUCCESSFULLY REPAIR ANY R1WURKS PRODUCT UNDER THIS WARRANTY OR REPLACE THE R1WURKS PRODUCT WITHOUT RISK OF DAMAGE TO THE PRODUCT. IT IS IMPORTANT TO NOTE THAT CERTAIN STATES (COUNTRIES AND PROVINCES) MAY DISALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE THE STATED LIMITATIONS OR EXCLUSIONS MAY NOT BE APPLICABLE TO YOU.
