R1 Brushless Motor Lab LLC, doing business as R1Wurks ("R1Wurks," "we," "us," or "our"), provides the R1Wurks Digital Pro mobile application for iOS and Android (the "App"). The App is used to configure, tune, monitor and update R1Wurks electronic speed controllers, Bluetooth modules and related products (the "Devices"). This Privacy Policy explains what information the App handles, how it is used, and the rights you have.

This Privacy Policy covers only the App. Our website and online store are covered by the R1Wurks store privacy policy.

The App was developed for R1Wurks by a software development partner. R1Wurks is responsible for the App.

2. Summary

• The App does not collect personal information. There are no user accounts and no sign in.
• The App does not send information over the internet. It communicates only with your Devices over Bluetooth.
• Your ESC settings, setups and logs stay on your phone. They are not sent to R1Wurks or anyone else.
• The App contains no advertising, no tracking and no analytics.
• We do not sell or share personal information.

3. Information Stored on Your Phone

When you connect the App to a Device, it reads and may store the following on your phone only:

• Device information: ESC model, serial number, hardware revision, firmware version and Bluetooth module identifier.
• Configuration data: your ESC settings, such as running mode, punch, PWM frequency, timing, turbo, brake, cutoff voltage and BEC voltage, and any setup or profile names you create.
• Telemetry and data records: operating data reported by the ESC, such as voltage, current, temperature, RPM, throttle position and run time.

This information never leaves your phone. You can delete it at any time by clearing saved setups in the App or by uninstalling the App.

4. Firmware Updates

The App does not download firmware. To update a Device, you download the firmware file yourself, for example from the R1Wurks website using your phone's web browser, and then select that file in the App. The App reads only the file you choose and sends it to your Device over Bluetooth. It does not access any other files on your phone.

Downloading a firmware file happens outside the App. Any information involved in that download is handled by the website you download it from and is covered by that website's privacy policy. Only load firmware files obtained from R1Wurks.

5. Information We Do Not Collect

The App does not collect your name, email address, phone number, mailing address, account credentials, payment information, government identifiers, location, contacts, photos, camera or microphone data, health information, browsing history, or information from other apps. The App does not include third party analytics, advertising, crash reporting or tracking software.

6. Permissions

The App asks your phone for the permissions below. You can change them at any time in your phone settings, though some features will not work without them.

• Bluetooth: required to find, connect to and communicate with R1Wurks Devices.
• Location (Android only): Android requires location permission, or the "Nearby devices" permission on newer versions, before an app can scan for Bluetooth devices. The App also checks whether location services are turned on so Bluetooth scanning works. The App does not record, store or send your location.
• Files and storage: used to open a firmware file you select and to save your setups and logs on your phone.
• Network and WiFi state (Android only): the Android version of the App lists network related permissions. The App does not use them to send or receive any information about you.

7. Sharing of Information

We do not sell personal information and we do not share it for cross context behavioral advertising. Because the App does not collect personal information, there is nothing for us to share. If you contact us by email for support, we use what you send only to answer your question, and we may disclose it if required by law, to protect the rights and safety of R1Wurks or others, or as part of a merger, acquisition or sale of company assets.

8. Data Retention

Data stored in the App remains on your phone until you delete it or uninstall the App. R1Wurks does not keep a copy. Support emails sent to us are kept for up to three years so we can reference past issues.

9. Security

Because the App does not send information off your phone, your data is protected by your phone's own security. We recommend keeping your phone locked with a passcode and only loading firmware files obtained from R1Wurks. If we learn of a security issue affecting the App, we will notify users as required by law, including California Civil Code Section 1798.82.

10. Your Privacy Rights

Residents of California and other states with consumer privacy laws, including Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia, may have the right to:

• Know what personal information has been collected about them and obtain a copy
• Request deletion or correction of personal information
• Opt out of the sale or sharing of personal information, targeted advertising and profiling
• Limit the use of sensitive personal information
• Appeal a denied request
• Not be discriminated against for exercising these rights

We extend these rights to all users in the United States. Because the App does not collect personal information, in most cases we will have nothing to provide, correct or delete, but we will respond to every request within 45 days. To make a request, email support1@r1wurks.com with "Privacy Request" in the subject line, or write to us at the address in Section 1. You may use an authorized agent with your signed written permission.

California disclosures. In the preceding 12 months we have not collected, sold or shared personal information of California residents through the App, and we do not disclose personal information to third parties for their direct marketing purposes (California Civil Code Section 1798.83). This policy serves as our notice at collection.

11. Children's Privacy

The App is intended for users age 13 and older. The App does not collect personal information from anyone, including children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). Parents with questions may contact us at support1@r1wurks.com.

12. Users Outside the United States

The App is offered from the United States. Because the App does not send information off your phone, no personal information is transferred to any other country through the App. If you are located in the European Economic Area, United Kingdom or another region with data protection laws, you may contact us to exercise any rights you have under those laws.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will change the "Last Updated" date above and, for material changes, provide notice in the App or on our website before the changes take effect.
